Frequently asked questions
What are the official Spanish immigration forms?
They are the forms published by the Ministry of Inclusion, Social Security and Migration (Ministerio de Inclusión, Seguridad Social y Migraciones) to start each procedure. There are two series: the 27 EX forms, for the procedures of the Ley Orgánica 4/2000 (the immigration law), and the 4 MI forms of the Ley 14/2013 (the Entrepreneurs Law). Separate from these are the forms for hiring from abroad and some communication forms that are only for guidance.
Where can I download the EX and MI forms?
On the website of the Ministry of Inclusion, Social Security and Migration, section «Modelos de solicitud» (application forms): the EX forms are under «Modelos generales» and the MI forms under «Apoyo a emprendedores». They are all editable and printable PDFs, and the Ministry itself warns that downloading the editable version does not work in every browser.
Which form goes with each procedure?
The procedure decides: the EX-03 is residence and work as an employee; the EX-02, family reunification; the EX-10, the arraigos and other exceptional circumstances; and the EX-17, the TIE (foreigner identity card).
Is the fee paid on the same form?
No. The fee (tasa) is separate, with its own 790 form: the 790-052 is the one of the immigration offices (residence permits, renewals, arraigos), the 790-062 pays for the work permit and the 790-012 is the Police one (NIE, TIE, certificates). Nationality is paid to Justice, with the 790-026.
Are the communication forms compulsory?
No. Besides the application forms, the Ministry publishes communication forms, such as the declaration of entry into Spain or the one about the schooling of dependent minors, and presents them as guidance, not compulsory. One of them, the designation of a representative (designación de representante), is required by some immigration offices: Aproba fills it in with the client's and the firm's details and adds it to the mandate.
